A 41-year-old lorry driver has been sentenced to five years in prison and fined RM30,000 after being found guilty of dangerous driving that caused the death of a motorcyclist last year.
Magistrate Don Stiwin Malanjum also ordered Abu Dari Kuraani to have his driving licence suspended for five years starting today. He will serve an additional year in jail if he fails to pay the fine.
The court ruled that the defence failed to raise reasonable doubt against the prosecution’s case after reviewing all evidence presented.
According to the charge, Abu Dari was accused of driving a Perodua Alza in a dangerous manner, resulting in the death of a motorcyclist at Jalan Chong Thien Vun at about 5.57pm on April 9 last year.
The offence falls under Section 41(1) of the Road Transport Act 1987, which carries a maximum penalty of 10 years’ imprisonment and a fine of up to RM50,000 upon conviction.
The prosecution argued that the offence was serious as it involved loss of life and public road safety, while also noting that the victim was the only son in his family.
The defence had appealed for leniency, stating that the accused was divorced, the sole breadwinner for his family, and had lost his job following the incident.
